For the purpose of maintaining the accuracy and genuineness of this Platform, you shall provide accurate and complete personal information to Ye Chiu. Any changes to the personal information shall be updated by you to Ye Chiu from time to time. If it is found that you have provided false information, Ye Chiu has the absolute right to suspend or the User will be suspended or permanently banned from the Site.

(1) We may occasionally update and change the Platform. We do not guarantee that the Platform, or its contents, will always be available. We may suspend or withdraw or restrict the availability of all or any part of the Platform for business and operational reasons.

(2) We reserves the right to modify, revise and vary the Terms of Use at any time as we see fit and any changes will be posted on our main page of the Platform or we will notify you of the same by means of a notice and link to the revised terms in our Platform. Please review these terms and conditions regularly to ensure you are familiar with the current version and understand all terms and conditions governing the use of this Platform. If you are an existing user, you may cancel your subscription by clicking “Disagree” and if you continue on using our Platform after changes have been made and posted, you shall be deemed to have agreed to such changes.

The security of personal information is a high priority for us. We maintain administrative, technical and physical safeguards to protect against unauthorized disclosure, use, alteration and destruction of the personal information in our possession. We are committed to providing appropriate security controls to protect personal information we have about you against foreseeable hazards. We also undertake to not disclose, transfer or alter users’ personal data and information save and except as deemed necessary to comply with any applicable law, regulation, legal process or governmental request.

Upon duly completing the relevant registration process and creating a username and password, you will be registered as a registered user of the Platform and the details of your account number/ username and password will be emailed to you. You are solely responsible for the security of your username and password and must keep your username and password confidential and must not disclose your username and/or password to anyone. You must inform Ye Chiu immediately if you become aware that your username and/or password have been compromised or if there is any illegal use of your account.

(1) This Platform is available on an “as is” and “as available” basis, with all faults and by using this Platform, you, as the user, agree to bear all risks associated with using this Platform.

(2) Ye Chiu hereby expressly makes no warranty or guarantee of any kind, expressed or implied, and expressly disclaims all expressed and implied warranties, including without limitation, that this Platform or the services under this Platform is error-free, will be free from any technical problems, will not be any changes to the objective environment or will be uninterrupted, on accuracy, completeness, up-to-date and reliability of the services and information under this Platform for a particular purpose of the users or that the services will meet the requirements of the users, that the information under this Platform can be transmitted completely, accurately, timely and smoothly, whether it can be modified in related software, that the security procedures taken on this Platform will prevent the loss of, alteration of, or improper access to the user’s information and that the Platform will not be subject to any system damage or data loss, bugs, computer virus attacks, hacking, network disconnection, worms, computer sabotage and/or other hacking attacks.

(3) In so far as is permitted by law, in no event shall Ye Chiu be liable to you, the user of this Platform, whether in contract, tort or otherwise, for any foreseeable, unforeseeable, direct, indirect, incidental or consequential loss of any kind, punitive or special damages of any kind, including without limitation, in connection with loss of profits or savings, personal injury, loss of business or revenues, loss of goodwill, loss or corruption of information and data, business interruption, interruption in service, viruses, deletion of files or electronic communications or errors, omissions or other inaccuracies arising out of or in connection with your use of the Platform.

(4) In so far as is permitted by law, you expressly, unconditionally and irrevocably agrees that regardless of any applicable law to the contrary, waives all your rights to file any claim, cause of action and legal action against Ye Chiu arising out of or related to this Platform including these Terms of Use and/or other agreements, guidelines or policies which may be associated with your use of the Platform.

(5) You acknowledge that you have satisfied yourself concerning the financial, legal, commercial, tax and other related considerations prior to registering to this Platform and further acknowledge and agree that you have read, understood, and agreed to be bound by all of these Terms of Use contained herein or any other terms and conditions (as may be amended from time to time by Ye Chiu without the need of giving prior notice), with full knowledge and understanding of the contents hereof, of your own free will and with full capacity and authority to do so.

(1) You must not use this Platform in any way that causes, or may cause, damage to the Platform or impairment of the availability or accessibility of the Platform; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

(2) You must not use this Platform to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

(3) You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Platform without our express written consent.

(4) You must not use this Platform to transmit or send unsolicited commercial communications. You must not use this Platform for any purposes related to marketing without our express written consent.

(5) Ye Chiu has the absolute right to determine whether the user's behaviour complies with the terms and requirements of these Terms of Use. If the user violates any of these Terms of Use, or the relevant behaviour on the Platform is reasonably viewed by Ye Chiu to be unfavourable to the Platform, Ye Chiu has the absolute right to at any time, you have the right to suspend, terminate and disable your account immediately in accordance with the “Violation” Terms below.

(1) You agree that Ye Chiu may, in its sole discretion and without prior notice, take such action as we deem appropriate, including but not limited to, disable, suspend or terminate your account and your access to the Platform and/or block your future access to the Platform and/or blocking computers using your IP address from accessing the Platform, if in our reasonable opinion you have failed to comply with and violated these Terms of Use and/or other agreements, guidelines or policies which may be associated with your use of the Platform.

(2) You agree to indemnify, defend and hold Ye Chiu harmless (including our directors, officers, employees, agents, subsidiaries, affiliates and/or other partners) from any damages, liabilities, costs and expenses (including reasonable legal fees) on account of any claim, suit, action, demand or proceedings made or brought against any such party, or on account of the investigation, defence, or settlement thereof, arising in connection with your use of the Platform, your violation of these terms and conditions and your violation of any rights of any other person in connection with the Platform including but not limited to, any infringement of intellectual property rights belonging to us or any third party arising out of any unauthorised use of intellectual property rights by you.

(3) You agree that Ye Chiu may, in its sole discretion and without prior notice, terminate your access to the Platform, due to reasons arising from, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Platform or any service offered on or through the Platform, or (4) unexpected technical issues or problems.

(1) Users may not use the account number to illegally log in and perform data destruction activities on this website.

(2) The user may not use multiple accounts or create more than 1 username and/or password to engage in the behavior of disturbing, manipulating or interfering with the quotation/ bidding. Once identified, the relevant users will be temporarily disqualified from the quotation. After the subsequent processing is finished, Ye Chiu will decide whether the user can continue to use his account and make a quotation.

(3) All users must strictly keep confidential their own purchasing behavior and related quotation data and quotation time.

(4) All users must standardize their own quotation behavior and actively cooperate with the investigation and supervision of the Ye Chiu e-Procurement platform.

(5) Any user who wins the bid will be contacted by our staff offline. Once the bid is won, the contract must be signed within the prescribed time limit according to the relevant requirements of the Ye Chiu e-Procurement platform.

(1) This Terms of Use and any other agreements or policies related to the use of this Platform shall remain in full force and effect while you use the Platform. You may terminate your membership at any time.

(2) Ye Chiu may terminate or suspend your access to the Platform or your membership at any time, for any reason, without warning, which may result in the forfeiture and destruction of all information associated with your membership.

(3) Upon termination of your account, your right to use and access the Platform or any content will immediately cease.

You agree that all matters relating to your access to or use of the Platform, including all disputes, will be governed by the laws of the Malaysia and you agree to comply with all laws applicable to you in using the Platform. In the event of any controversy or dispute between Ye Chiu and you arising out of or in connection with your use of the Platform, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time, then either party may submit such controversy or dispute to the courts of Malaysia situated in the State where Ye Chiu’s business place is located.
